RE: Notification Regarding Potential Designation of the Ontario Place Redevelopment - Request for Input

Good Evening,

On October 13, 2023, the Supreme Court of Canada found the designated project provisions of the federal Impact Assessment Act to be unconstitutional. Accordingly, there is no constitutional basis for the Minister to designate the Project.

That being said, MNRF has reviewed the information provided in the attached letters regarding the Spa Complex Project and the Underground Garage Project with our legislative and regulatory processes and approvals administered by our ministry and would like to provide the following. The responses below have been provided on the assumption that the developer of the project is subject to provincial legislation.

SPA Complex Project

  • Based on the description provided in the attached letter authorizations under the Public Lands Act (PLA) may be required from MNRF (e.g. if the project involves unpatented public lakebed or shorelands (privately held or public inundated lands). Further assessment would be required to identify necessary due diligence and determine if consultation is required with Indigenous people.
  • Further information on the Spa Complex Project would be required to determine if authorizations under the Fish and Wildlife Conservation Act, 1977 are required.

 

Underground Garage Project

  • Based on the information provided, MNRF is not anticipating this project requiring authorizations from MNRF.
