Notice of Determination

North Vancouver, B.C. – June 28, 2024 – The Vancouver Fraser Port Authority has determined that the proposed VanPile maintenance dredging located at the mouth of Lynn Creek in North Vancouver is not likely to cause significant adverse environmental effects.

The determination was based on a consideration of the following factors:

  • Impacts on rights of Indigenous peoples
  • Indigenous knowledge
  • Community knowledge
  • Comments received from the public
  • Technically and economically feasible mitigation measures

Best efforts were made to consult with Musqueam Indian Band, S'ólh Téméxw Stewardship Alliance, and Tsleil-Waututh Nation. No comments relating to the project were received from Indigenous groups.

The project was posted to the Canadian Impact Assessment Registry on March 11, 2024, for public comment. No comments were received.

The District of North Vancouver, Neptune Terminals, and the North Shore Stream Keepers were notified. The themes raised were:

  • Collaboration opportunities regarding future potential projects at Lynn Creek estuary
  • Clarity on the proposed dredge footprint in relation to conservation- and terminal-designated areas
  • Stakeholder engagement (i.e., Neptune Terminals) and consideration of nearby proposed projects
  • Potential impacts to the stability of the dyke/spit nearby

Mitigation permit conditions taken into account in making the determination include:

  • There will be no in-water works during the fisheries-sensitive period from March 1 to August 15, inclusive
  • Turbidity will be monitored, and the physical activities will be conducted in a manner to avoid high induced turbidity of local waters
  • A spill prevention, containment and clean-up plan will be developed for the project, and be available in the immediate working area, and project personnel will be trained on spill prevention, containment, and clean-up
  • The barge and other support vessels will be prevented from grounding on the foreshore, riverbed or otherwise disturbing the foreshore or riverbed
  • All debris and waste materials will be collected in the immediate working area and disposed of at an appropriately licensed facility

The Vancouver Fraser Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.
