Notice of Determination

British columbia – September 28, 2021 –  Indigenous Services Canada has determined that the Tlowitsis Nation-Nenagwas Village Development project is not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors:

· Impacts on rights of Indigenous peoples;

· Indigenous knowledge;

· Community knowledge;

· Comments received from the public; and

· Technically and economically feasible mitigation measures.

 

Mitigation measures taken into account for this determination are:

  • Implement soil management measure to avoid any impact on soil
  • Implement all mitigation measures and directives provided by the Regulators for the outfall installation and operation
  • Implement mitigation measures to protect migratory birds and species at risk if present.  Avoiding work during nesting season.
  • Implement mitigation measures related to the protection of fish habitat
  • Maintain all riparian zones and sensitive areas free of disturbance
  • Develop a detailed environmental management plan and erosion sediment control plan to be followed during construction
  • Develop an emergency plan for any emergency situation and avoid any equipment maintenance on site
  • Have a qualified environmental professional on site to supervise the work
  • Address all mitigation measures identified by Federal Regulators and by the Province of BC Environment

ISC is satisfied that that the carrying out of the project is not likely to cause significant adverse environmental effects. Therefore, ISC may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
