Notice determination

March 12, 2021 – Indigenous Services Canada has determined that the proposed Nipissing First Nation – New Road Development: Yellek to Duchesnay is not likely to cause significant adverse environmental effects

The determination was based on a consideration of the following factors:

• The proposed project has been assessed against the communities' internal environmental review as part of the First Nation Land Management agreement, which has found the project has negligible impact on the surrounding environment when taking into consideration the proposed mitigation measures
• The new roadway will provide Nipissing First Nation with a safer route of travel between the communities of Yellek and Duchesnay, resulting in an increased measure of safety for the community members living in the area.
• The proposed mitigation measures from the project consultant will adequately address any environmental issues that could present itself during the roadway construction.

Implementation of mitigation measures is required for the project to address:

• The roadway crossing over waterways
• The removal of ballast from the abandoned CN railway
• The potential for silt to be increased along the shoreline
• The potential of SAR habitat in the area

Indigenous Services Canada is satisfied that that the carrying out of the project is not likely to cause significant adverse environmental effects.

Therefore, Indigenous Services Canada may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
