On September 23, 2013, the Canadian Environmental Assessment Agency (the Agency) provided notice to the Cowichan Tribes of a 20-day public comment period on the project description from Port Metro Vancouver (the proponent) for the Roberts Bank Terminal 2 Project (the Project).

Based on a review of the project description and comments received, including the possibility that the Project may cause adverse environmental effects on areas of federal jurisdiction, the Agency has determined that a federal environmental assessment (EA) is required under the Canadian Environmental Assessment Act, 2012.

The Agency invites the Cowichan Tribes to review and comment on the draft Environmental Impact Statement (EIS) guidelines (attached). Information is also being provided to further explain the next phase in the EA process and how Crown consultation will be integrated into the EA process.

The purpose of the EIS guidelines is to identify for the proponent the information requirements for their preparation of an EIS for a designated project1. The EIS guidelines specify the nature, scope and extent of the information required. Please note that the deadline for submitting comments for consideration in the finalization of this document is December 8, 2013.

At this time, the Minister of the Environment may decide to refer the project to a review panel, if it is likely to cause significant adverse environmental effects, or Aboriginal groups and/or the public have raised concerns related to the potential for significant adverse environmental effects.

Crown consultation will be integrated into the EA process to the greatest extent possible. The Agency will be responsible for coordinating federal-Aboriginal consultations related to potential or established Aboriginal or Treaty rights that could be adversely impacted by the proposed Project. Please provide us with contact information for staff or other representatives who may be authorized to coordinate consultation activities and information-sharing on behalf of the Cowichan Tribes.

Federal funding may be made available to support the participation of some Aboriginal groups during later phases of an EA (EIS Review and EA Report Review). The Agency will advise you of any opportunities to apply for funding. Information on the Agency's Participant Funding Program, including the Guide to the Participant Funding Program, is available at: www.canada.ca/en/environmental-assessment-agency.html.

Information that you provide to the Agency is considered public and may be subject to public access to information requests. On September 23, 2013, the Canadian Environmental Assessment Agency (the Agency) provided notice to the Semiahmoo First Nation of a 20-day public comment period on the project description from Port Metro Vancouver (the proponent) for the Roberts Bank Terminal 2 Project (the Project).

Based on a review of the project description and comments received, including the possibility that the Project may cause adverse environmental effects on areas of federal jurisdiction, the Agency has determined that a federal environmental assessment (EA) is required under the Canadian Environmental Assessment Act, 2012.

The Agency invites the Semiahmoo First Nation to review and comment on the draft Environmental Impact Statement (EIS) guidelines (attached). Information is also being provided to further explain the next phase in the EA process and how Crown consultation will be integrated into the EA process.

The purpose of the EIS guidelines is to identify for the proponent the information requirements for their preparation of an EIS for a designated project1. The EIS guidelines specify the nature, scope and extent of the information required. Please note that the deadline for submitting comments for consideration in the finalization of this document is December 8, 2013.

In this document "project" has the same meaning as "designated project" as defined in the Canadian Environmental Assessment Act, 2012.

At this time, the Minister of the Environment may decide to refer the project to a review panel, if it is likely to cause significant adverse environmental effects, or Aboriginal groups and/or the public have raised concerns related to the potential for significant adverse environmental effects.
