Notice of Determination

Ottawa, Ontario – March 13th, 2025 The National Capital Commission and Parks Canada have determined that the proposed project is not likely to cause significant adverse environmental effects with the application of all recommended mitigation measures.

This determination was based on a consideration of the following factors:

  • impacts on rights of Indigenous peoples;
  • Indigenous knowledge;
  • community knowledge;
  • the temporary nature of the proposed installation, and the reversibility of the effects.
  • technically and economically feasible mitigation measures; and
  • the components of the environment that are within the legislative authority of Parliament identified in the "Definitions" section of the Impact Assessment Act

Mitigation measures will be implemented to address potential adverse effects on the following components of the environment:

  • migratory birds;
  • species at risk;
  • surface water;
  • soil quality;
  • vegetation;
  • human health;
  • archaeological resources; and
  • historical resourcs

Some of the mitigation measures considered for this determination are:

  • Contractors and other staff working on the project will maintain documentation on site to assist with wildlife identification.
  • Conduct daily visual inspections of the work site for wildlife.
  • Follow guidance and conditions found within the Department of Fisheries and Oceans Canada Interim Code of Practice: Repair, Maintenance and Construction of Docks, Moorings and Boathouses to Protect Fish and Fish Habitat.
  • During construction phase monitoring an NCC biologist will complete visual inspection while anchors are being installed to provide guidance from fish and fish habitat perspective.
  • The NCC will visually monitor the stormwater pipe extension and be able to access any changes to sediment patterns observed.
  • No excavation or levelling of sediment will be permitted.
  • Implement soil management plan.
  • Implement an erosion and sediment control plan.
  • Implement spills response and action plan.
  • Clean all heavy equipment and ensure it is free of invasive species prior to accessing federal lands.
  • Implement tree protection fencing for trees in access areas and staging area.
  • Upon completion of construction, all disturbed areas must be reinstated to existing condition or better.
  • The project has been reviewed by heritage specialists at the NCC and Parks Canada, and the project has been designed to conserve cultural resources.

After reviewing the comments received and conducting an internal review of effects, the National Capital Commission and Parks Canada are satisfied that the implementation of the project is not likely to cause significant adverse environmental effects, as long as all mitigation measures are applied. Therefore, the National Capital Commission may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
