Notice of Transition to the Amended Impact Assessment Act

Ottawa — October 23, 2024 — On June 20, 2024, the Budget Implementation Act, 2024, No. 1 received Royal Assent and brought into force amendments to the Impact Assessment Act (the IAA). Transitional provision 305 of the Budget Implementation Act, 2024, No. 1 states that in order to bring a designated project under the IAA, the Minister of Environment and Climate Change or the Impact Assessment Agency of Canada (IAAC) must take a step with regard to the project under any of sections 10 to 59 of the IAA.

In accordance with transitional provision 305(2), IAAC is taking the following step under the IAA for the Marban Gold Mine Project:

  • Subsection 18(5) Suspending time limit and posting reasons for the suspension

In posting this notice, any step completed before the amended IAA came into force regarding the Marban Gold Mine Project is deemed to have been taken under the amended IAA.

Time limits

Transitional provision 305(4) of the Budget Implementation Act, 2024, No. 1 grants IAAC the power to replace any time limit or period established by or under the IAA with another time limit or period.

IAAC is not replacing any time limit or period for the Marban Gold Mine Project. The time limit for the planning phase will remain 180 days and 67 days have elapsed.
